Former EMT Still Pursuing Lawsuit Against 84-Year-Old

MOUNT DORA, FL — When firefighters rushed Steuart Baker’s mother to the hospital in May 2005, he never expected anyone to sue her.

Elizabeth Baker, now 84, has moved into an assisted-living facility. But her son continues trying to fend off the lawsuit filed against his mother by a firefighter-emergency medical technician with Lake County Fire Rescue.

Jennifer Roland claims she suffered back and neck injuries when the front left wheel of a fire engine broke through the lid of an old septic tank in front of Elizabeth Baker’s house in Mount Dora.

The lawsuit, filed a year ago in Circuit Court, seeks unspecified damages of more than $15,000.

From the start, Steuart Baker said, he’s been upset that a paramedic would sue a patient.

“Police officers, firemen, paramedics are public servants,” he said.

“If I call a paramedic and they hurt themselves they’ll sue me? That wasn’t how public service was intended.”

Roland would not comment on the case. But her attorney, Kim Cullen of Orlando, said that he thought that the paramedic was within her rights to sue.

Baker, a gun-shop owner in Mount Dora, grew up on the property with his parents and brothers, including state Sen. Carey Baker, R-Eustis. He said no one knew about the septic tank until a fire engine arriving to take his mother to the hospital broke through the lid during an emergency call in March 2005.

The engine had to be pulled out with a tow truck.

After that, Baker said, he filled the tank in with sand himself, and thought the problem was solved. But in her lawsuit, Roland says she was hurt while riding on a fire vehicle that broke through the septic-tank lid on another emergency call two months later.

Steuart Baker is coordinating the family’s defense of the suit because his mother is too ill to handle it herself.

Roland’s personnel file indicates she has received above-average performance reviews since joining Lake County Fire Rescue in 2001.

The file also contains documents pertaining to Roland’s multiple periods of medical leave and light duty since the accident.

Christopher Patton, a spokesman for Lake County government, said that Roland had received worker’s compensation benefits, but would not specify how much, citing privacy laws.

Patton said that Roland notified her superiors when she filed the lawsuit, but that they now are looking at the case with more scrutiny.

“They didn’t actually view the lawsuit. They didn’t understand all of the ramifications that were involved,” Patton said.

“Perhaps we’re at fault for not investigating what the intentions were in the suit.”

Last October, Casselberry police Sgt. Andrea Eichhorn sued the family of then 2-year-old Joey Cosmillo, who fell into a swimming pool, suffering severe brain damage, in January 2007. Eichhorn responded to the scene, slipped in a puddle, fell, and broke a kneecap.

Eichhorn dropped the lawsuit less than two weeks after she filed it, in response to numerous complaints and criticism from the public.

The Casselberry Police Department fired her in December after an internal investigation concluded that she had violated several department policies, including damaging the department’s image and filing suit without giving the police chief advance written notice.

Patton would not say whether Lake County Fire Rescue would take action against Roland. But he said that the public shouldn’t fear calling 911 because of potential legal ramifications.

“Any time you call 911, there is an expectation that you should be safe and not in harm’s way,” he said.

    There's no rescue from lawyers and there fine print. I'm shure it wasn't just Jennifer's idea to sue an 84 year old women. We have to give the lawyers there credits. Jennifer was injuryed on the job and compensation sometimes takes longer than we would like. But that's no reason to sue the very people she was paid to help in there time of need. Make shue your in this job for the right reasons. All to often we pay with our lives. We shouldn't undermind what others have already paid. We all should keep the brotherhood in the back of our minds when talking to lawyers. There loyalty is to money alone.

    You know when u become a Firefighter/EMT and go thru the academy you are supposed to be just about able to handle any call. I think this is a free ride for her, must not like her job or something and to sue any elderly person, after all they have done for our country and for us is totally totally very UNPROFESSIONAL. Jennifer if u can't handle the job u were not meant to be a Firefighte/EMT. Funny, she is the only one claiming an injury from that responding unit? How many more calls she responds to, will she claim an injury?! I am a retired 911 ambulance dispatcher we serve, HELP and protect, not sue.

    can we say workmans comp to sue an elderly pt is just wrong some people don't deserve to be called rescuers you are there to help not to hurt physically or financially . gives all good rescuers a bad name . I am a volunteer and i find this to be very disturbing

    There comes a time when people should just say enough is enough. 1st and most the city should be the med cost and not the patient. What are we all going to sue for emotional distress and tuck our balls between our legs and say I am not doing that or the hell with you I am not saving a life today. Lawsuit have there place and should be directed to the employer not the patient. Also were are the SOP's that give protocol to not take 40K fire truck off road. Where was her seat belt. She should be fired for not adhering to policey.

    It looks to me Jennifer Roland is looking for an easy way out. Sueing the people that pays her wages is STUPID. She wanted to be a firefighter, so WELCOME TO THE REAL WORLD OF FIREFIGHTING. Knock off the BS and get back to work Jennifer Roland.

    unable to picture the scene, in accessing the patient, was this the only route availiable to the response team, to drive over the septic tank? Any how the emt/driver must have been aware of the vehicle weight and should have had a second thought about driving over a possible unsecure area. Scene safety should have been a priority upon approaching the scene. Sorry I agree, this seems like a get rich quick scheme. I agree with the other comments given, There are other options that this EMT could have taken. I don't see why she would want to add to the elderly patient problems. What's this world coming to?

    Man, as if the public already didn't have enough to talk about. Suing an elderly patient is unbelieveable. In my opinion if she could remember enough that she wasn't hurt the first time but 2 months later at the same house same incident occurring again the why didn't she say something like don't go there we fell through the septic tank last time. No wonder people have a bad image of us. Grant it we don't get paid what we deserve, but in my opinion if you don't like what you are being paid move on. Why make a stupid lawsuit against an elderly person barely able to pay her medication every month when you were aware of a possible safety issue with the scene. BTW where was the septic tank? I'm sure it wasn't on the road or the driveway. Why did the operstor drive into the yard? Too many questions. I hope she has other schooling for another trades because unless she has a reasonable case here that I haven't seen yet, I don't see her working in public safety for too much longer. Maybe she can go work chasing ambulances instead of manning one. Sorry this just infuriates me. I hope she can sleep at night because I'm sure the minimal pain she felt after the "accident" is nothing like the pain of the family having to deal with this idiot suing their elderly family member.

    I agree this one is silly, but what do you do when the public is negligent? Do you depend on an overworked and underpaid workers comp beruau that is supported off of not paying out claims. I look at the cluster !@# that the governement has turned the federal death benfits program into and think we as responders need some avenue to protect us and our families when we become patients or worse.

    everyone in ems knows the risk involved in our job but we do it any way dosent matter how long you work your bound to get hurt you know the risk when you start this job you get hurt you deal with it you dont sue the ones your supposed to be helping

    WTF,,,,,,, Beware future patients if you pass gas and I don't like the smell of it I'll see you in court BTW, This smells of complete BS. If I was the patient I'd sue the paramedic for being a dumb azz. Good Lord it is the sign of the times.

    I agree with all of thecomments that have been posted...as a firefighter/medic of 16 years, I cannot believe that another medic is taking a lawsuit against a patient!?...that is insane!...We are supposed to be out there to serve the public and provide care for the sick and injured....Injuries are part of the job....when we do get hurt you don't look to blame those that we are supposed to be helping....and I like the comment on "scene safety"...as an instructor, I know that is drilled into us from the very first basic first aid class, all the way to the Paramedic program....scene safty is always the most important thing....I just can't believe that this has happened....What happened to the Emergency Services that used to be about the people we protect and serve....I guess some people are just that selfish....even in our line of work.
